Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (WhispaWave UG (haftungsbeschränkt), Amsterdamer Weg 7, 44269 Dortmund, Germany, email: widerruf@whispawave.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory. You can also exercise your right of withdrawal online at https://whispawave.de/en/widerrufen. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Special notes (early start of the service, compensation for value)

• Immediate start at your request: WhispaWave makes the paid features available to you immediately after purchase. When you order through our website, during checkout we therefore ask for your express request that we begin performing the service before the withdrawal period expires, and for your confirmation that you know you must pay us a proportionate amount for the service provided until your withdrawal if you withdraw (Section 357a(2) of the German Civil Code (BGB) — calculation as described under “Effects of withdrawal”).
• Your right of withdrawal remains in place: Even if we begin the service immediately at your request, you can withdraw from the contract within the 14-day period. Your right of withdrawal does not lapse when you start using the service.
• Free Pro trial period (without a payment method): This trial period is free of charge and does not automatically turn into a subscription; the right of withdrawal only concerns the later conclusion of the paid subscription.
• Team trial period (with a payment method on file): The contract for the paid Team subscription is already concluded when the team is created; the first charge is only made after the trial period ends. Your 14-day withdrawal period therefore already begins on the day the contract is concluded (the day the team is created) — not only with the first debit. If you cancel the team or dissolve it before the trial period ends, no payment obligation arises.
• Referral program: If you, as a referred person, withdraw within the withdrawal period, a reward granted to the referring person for referring you is reversed (details in the terms of participation in the referral program).
• Purchases in the App Store (iPhone app): Subscriptions that you take out in the iPhone app are sold to you by Apple Distribution International Ltd. (Ireland) in its own name and for our account. In the German and the Austrian App Store, you can declare your withdrawal from such a purchase to Apple under Apple's terms — for example in your Apple Account under “Purchase History” with “Withdraw Transaction” — or to us. Apple's terms for the Swiss App Store do not provide for a right of withdrawal. Refunds of payments that you made to Apple are handled by Apple; we will help you with this. Details in section 23 of the Terms of Service.
